PLEASE READ CAREFULLY – THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS (INCLUDING WAIVER OF RIGHT TO SUE AND JURY TRIAL)
This Liability Waiver and Release of Claims (the “Agreement”) is entered into by the undersigned participant (the “Participant”) in favor of Leones Training Center, LLC, its owners, officers, employees, trainers, contractors, agents, affiliates, property owners/landlords, insurers and insurance carriers, and all other persons or entities acting on their behalf (collectively, the “Released Parties”). This Agreement applies to all services, memberships, and access (as permitted by your specific membership level), including but not limited to boxing classes, cardio boxing, Brazilian Jiu Jitsu, adaptive boxing, HIIT fitness classes, bootcamps, open gym use, sparring, personal training, events, and use of the recovery room and all equipment (collectively, the “Activities”).
1. ASSUMPTION OF RISK
I understand that all Activities involve inherent risks, including serious injury, permanent disability, or death. These risks include but are not limited to: physical contact during boxing/sparring/partner drills; use of equipment (weights, bags, ring, mats); 24-hour facility access without staff supervision; use of recovery services (sauna, cold plunge, compression therapy, etc.); slips, falls, equipment failure or misuse; and physical exertion (including heart-related events, dehydration, or overexertion). I knowingly and voluntarily assume all such risks.
2. RELEASE OF LIABILITY (INCLUDING NEGLIGENCE)
To the fullest extent permitted by California law, I waive, release, and agree not to sue the Released Parties for any injury, illness, death, or property damage arising out of or related to my participation in the Activities, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.
3. EXCLUSIONS (CALIFORNIA LAW)
Nothing in this Agreement releases or limits liability for gross negligence, reckless conduct, or intentional misconductto the extent such limitation is prohibited under California law.
4. INDEMNIFICATION
I agree to defend, indemnify, and hold harmless the Released Parties from any claims, damages, or expenses (including attorneys’ fees) arising from my participation in the Activities or my actions while on the premises.
5. 24-HOUR ACCESS & UNSUPERVISED USE
I understand that, if my membership allows, I may access the facility during unstaffed hours and accept full responsibility for my safety and conduct when no supervision is present.
6. RECOVERY ROOM USE
I understand that, if my membership allows, the sauna, cold plunge, and other recovery tools involve additional risks. I agree to follow all posted guidelines and assume full responsibility for any injury or adverse effects.
7. MEDICAL & FITNESS ACKNOWLEDGMENT
I certify that I am physically able to participate and have no condition that would make participation unsafe. I authorize emergency medical care if needed and accept responsibility for all related costs.
8. DISPUTE RESOLUTION; WAIVER OF JURY TRIAL
Any dispute arising out of or related to this Agreement or the Activities shall be resolved by binding arbitration in California under applicable rules. I waive the right to a trial by jury. The arbitrator shall have authority to award any relief available in court, consistent with this Agreement and California law.
9. MINORS
If the Participant is under 18, the parent/guardian agrees to all terms, accepts all risks on behalf of the minor, and releases the Released Parties to the fullest extent allowed by law.
10. GENERAL TERMS
This Agreement is governed by California law. If any provision is found unenforceable, the remainder remains in effect. This Agreement applies to all current and future visits and participation.
ACKNOWLEDGMENT
I have read and understand this Agreement. I am signing it voluntarily and understand that I am waiving important legal rights.
